By accessing, browsing, submitting a commission request, purchasing artwork, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Website or its services.

Throughout these Terms and Conditions, “Giorgio Baldini Art,” “we,” “us,” and “our” refer to Giorgio Baldini, doing business as Giorgio Baldini Art, and the owner and operator of this Website.

3. COMMISSION SERVICES

By submitting a commission request, you agree to these Terms and Conditions.

All commission requests are subject to acceptance and approval by Giorgio Baldini Art. We reserve the right to decline or cancel any commission request at our sole discretion.

Pricing for commissioned artwork is based on factors including, but not limited to, size, medium, complexity, materials, and project requirements. Any quoted price is valid only for the specific project described and may be subject to revision if the project scope changes.

Due to the custom nature of commissioned artwork, deposits and payments may be non-refundable once work has commenced. Refund requests will be evaluated on a case-by-case basis and may be reduced based on work already completed, materials purchased, or other project-related costs.

Any requested revisions, modifications, framing services, additional shipping, or other changes beyond the original commission agreement may result in additional charges.

4. PRICING AND PAYMENT

Prices listed on the Website are subject to change without notice.

Unless otherwise stated, listed commission prices include standard shipping but do not include applicable sales tax, framing, customs duties, import fees, or other governmental charges.

Accepted forms of payment include cash, check, Venmo, Zelle, and any other payment methods approved by Giorgio Baldini Art.

Returned checks or failed payments may be subject to applicable bank fees, collection costs, and any remedies available under applicable law.

Artwork will not be shipped or delivered until all required payments have been received and cleared.

5. ARTWORK QUALITY AND CUSTOMER EXPECTATIONS

Artwork is created using the reference materials and information provided by the customer.

The quality, appearance, and level of detail in the finished artwork may vary depending on factors including, but not limited to, the quality of reference images, artwork size, medium, materials, and artistic interpretation.

While every reasonable effort will be made to create a high-quality and accurate representation, Giorgio Baldini Art does not guarantee that the final artwork will exactly match any reference image, digital preview, sample image, or customer expectation.

Customers acknowledge that commissioned artwork is an original artistic work and involves creative judgment and interpretation.

6. INTELLECTUAL PROPERTY AND COPYRIGHT

All content displayed on the Website, including artwork, photographs, videos, graphics, logos, text, tutorials, designs, and other materials, is protected by copyright, trademark, and other intellectual property laws and remains the exclusive property of Giorgio Baldini Art unless otherwise stated.

The purchase of artwork does not transfer any copyright, reproduction rights, commercial rights, licensing rights, or intellectual property rights unless expressly granted in writing.

Customers may not reproduce, copy, distribute, modify, publish, sell, create derivative works from, or commercially exploit any artwork or content without prior written permission from Giorgio Baldini Art.

Unauthorized use of copyrighted materials may result in legal action and the pursuit of all remedies available under applicable law.

7. REFERENCE IMAGES AND CUSTOMER CONTENT

By submitting photographs, images, or other reference materials, you represent and warrant that you own the materials or have the legal right to provide them for use.

You grant Giorgio Baldini Art a non-exclusive license to use submitted reference materials for the purpose of creating commissioned artwork and, unless otherwise agreed in writing, for portfolio, promotional, educational, and marketing purposes.

Giorgio Baldini Art is not responsible for any claims arising from a customer’s unauthorized use of third-party images or materials.

8. PORTFOLIO AND PROMOTIONAL USE

Unless otherwise agreed in writing before work begins, Giorgio Baldini Art reserves the right to photograph, display, publish, reproduce, and promote commissioned artwork and related work-in-progress images on the Website, social media platforms, marketing materials, portfolios, educational content, and other promotional channels.

9. SHIPPING AND DELIVERY

Shipping times are estimates only and are not guaranteed.

Risk of loss and title transfer to the customer upon delivery of the artwork to the shipping carrier.

Customers should inspect shipments promptly and notify Giorgio Baldini Art of any shipping damage or delivery issues within seven (7) days of receipt.

Additional shipping requests, reshipments, or returned shipments may be subject to additional fees.

10. USE OF WEBSITE AND SERVICES

You agree not to use the Website or services in any unlawful, fraudulent, abusive, defamatory, or otherwise inappropriate manner.

We reserve the right to suspend, restrict, or terminate access to the Website or services for violations of these Terms and Conditions or for any conduct that we reasonably believe may harm Giorgio Baldini Art, its customers, or its business operations.

Any disputes arising under these Terms and Conditions shall be resolved in the appropriate state or federal courts located within California, and the parties consent to the jurisdiction of such courts.
